Liability Waiver

Acknowledgement of the risks of participation, and the release agreed to at registration.

This waiver is agreed to by a parent or legal guardian as part of registration, on their own behalf and on behalf of the athlete being registered.

Please read it carefully. If anything is unclear, ask us before registering.

Acknowledgement of risk

Volleyball is a physical sport. Participation in training, drills, conditioning and competitive play carries an inherent risk of injury that cannot be eliminated, however well a program is run.

Risks include, but are not limited to:

  • sprains, strains, fractures and dislocations;
  • contact with the ball, the floor, equipment, teammates or opponents;
  • collisions during play, blocking or defensive movement;
  • injuries arising from jumping, landing and rapid changes of direction;
  • head injuries, including concussion;
  • aggravation of a pre-existing condition or injury;
  • in rare cases, serious or catastrophic injury.

By registering an athlete, you acknowledge these risks, and confirm that participation is voluntary.

Confirmation of fitness

You confirm that, to the best of your knowledge, the athlete is physically fit to participate, and that you have disclosed all relevant medical conditions, injuries, allergies and medications through our Medical & Emergency Consent.

You agree to update us promptly if that changes.

Release

To the fullest extent permitted by law, and in consideration of being permitted to participate, you agree to release and hold harmless Prime Potential Volleyball, its owners, directors, coaches, staff, volunteers and facility partners from claims, demands and causes of action arising from ordinary risks inherent in participation.

This release does not apply to, and nothing in it limits liability for:

  • gross negligence or wilful misconduct;
  • a failure to meet our own duty of care toward athletes;
  • any liability that cannot be excluded or limited under applicable law, including in respect of a minor.

Agreement to rules and conduct

You agree that the athlete will follow the instructions of coaching staff, our Athlete Code of Conduct, and the rules of any facility we use — including those relating to footwear, equipment and safe use of the space.

You accept that we may remove an athlete from an activity where we judge it necessary for their safety or the safety of others.

Insurance

You acknowledge that Prime Potential Volleyball does not provide personal medical, dental or disability insurance for participants, and that responsibility for such coverage rests with the family. Costs of medical treatment or transport are your responsibility.

Authority to agree

You confirm that you are the parent or legal guardian of the athlete being registered, that you have the authority to agree to this waiver on their behalf, and that you have explained its substance to them in terms appropriate to their age.

Duration

This waiver applies to all Prime Potential Volleyball programs, sessions, open gyms, tryouts and events in which the athlete participates, until it is withdrawn in writing. Withdrawing it may mean the athlete can no longer participate.

Governing law

This waiver is governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it.
